OVERVIEW & ACCEPTANCE OF TERMS Welcome to Breathe & Bloom Design. The terms “we”, “us”, and “our” refer to Breathe & Bloom Design, its studio 'Breath & Bloom Studio' and educational division 'The Artisan Academy'. Breathe & Bloom Design operates this e-commerce storefront, educational booking platform, and related in-person creative studio services (the “Services”). Our online storefront is powered by Shopify, which provides the infrastructure enabling us to deliver the Services to you.

By visiting our site, placing an order, registering for a workshop or term program, booking a private event, or accessing our studio premises, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use or access our Services.

SECTION 1 – ACCESS, AGE & ACCOUNT INTEGRITY

  1. By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence (18 years of age in Australia), or that you are the parent/legal guardian providing consent for your minor dependents to use our Services or participate in our workshops.

  2. You represent and warrant that all billing, student enrolment, and shipping details you supply are accurate, current, and complete.

  3. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

SECTION 2 – HANDMADE HOMEWARES, TIMBER TERMS & CARE

  1. 100% Native Tasmanian Hardwood: Every handcrafted wooden piece (including statement clocks, serving paddles, and platters) is made from 100% sustainably salvaged native Tasmanian hardwood (Tasmanian Oak, Blackwood, Celery Top Pine, and salvaged Macrocarpa).

  2. Natural Timber Movement: Timber is an active, organic material that naturally responds to atmospheric changes. Subtle variations in grain, tone, natural checking, and minor seasonal movement (expansion or contraction of 1–2mm) are inherent characteristics of authentic solid timber and do not constitute manufacturing defects.

  3. Timber Care Obligations: To preserve your piece, you must strictly avoid dishwashers, prolonged soaking in water, exposure to direct sunlight, or placement directly above artificial heat sources.

  4. Resin Art Variations: All multi-layer ocean and decorative resin accents are hand-poured in small batches in our private artisan studio. Flow lines, wave lacing, and color gradients are inherently unique to each individual piece.

SECTION 3 – ORDERS, MADE-TO-ORDER DROPS & VOLUME GIFTING

  1. Offer and Acceptance: Placing an order constitutes an offer to purchase. We reserve the right to accept, limit, or decline your order for any reason prior to dispatch or production commencement.

  2. Seasonal Made-to-Order Drops: Products purchased during limited seasonal drops require 100% upfront payment prior to timber preparation and private studio resin pours. Due to the custom cutting and multi-day resin curing cycle, made-to-order items cannot be cancelled or amended once production begins.

  3. Corporate & Settlement Hampers: Custom client branding (such as Cricut gold vinyl decals encapsulated under flood coat resin) must be formally approved in proofing before resin application. Tiered volume orders are non-refundable once custom fabrication is underway.

SECTION 4 – BLOOM CREATIVE ACADEMY: ENROLMENT & ATTENDANCE Bloom Creative Academy provides low-sensory, screen-free tactile mixed media instruction designed around intentional small-group ratios (maximum 12 students per session).

  1. Student Enrolment & Medical Disclosures: Guardians must submit a completed Student Enrolment & Medical Waiver at least 7 days prior to Week 1 of each term. You must disclose all severe allergies, asthma, sensory preferences, and learning support needs to help us maintain a safe, inclusive environment.

  2. Nut-Aware Policy: To protect participants with severe anaphylaxis, all studio sessions operate as strictly Nut-Aware. All packed snacks, lunches, and personal treats brought into studio venues must be 100% nut-free.

  3. Sibling Discount Tiers: Discounts apply strictly to concurrent, multi-week term enrolments within the same family:

  • First Child: Standard full term tuition

  • Second Sibling: 10% discount on term tuition

  • Third Sibling+: 15% discount on term tuition

  1. Parent Helper Rebates: Parents participating in the designated Parent Helper program must hold an active Tasmanian Working with Vulnerable People (WWVP) registration to qualify for the 20% term tuition rebate, valid for one child per term, or pro-rata in line with Parent Helper attendance.

SECTION 5 – FEES, TRANSFERS, SICKNESS & CANCELLATIONS Because classroom places are strictly capped at 12 students and teaching supplies are prepared in advance, the following policies apply:

  1. Administrative Fee: All voluntary cancellations, class transfers, or eligible refunds are subject to a flat $25.00 Administration Fee.

  2. Term Enrolment Cancellations:

  • Notice given 14+ days prior to Term start: Full refund less the $25 administration fee.

  • Notice given under 14 days before Term start or after commencement: Strictly non-refundable.

  1. Student Absence & Illness Exception: If a student misses a term class due to illness and provides a valid Medical Certificate within 7 days of the missed class, a credit voucher valued at $29.50 will be issued. Credit vouchers are redeemable toward upcoming Holiday Camps, weekend workshops, or future term fees.

  2. Events and Private Bookings (Luxe & Pour, Makers Birthday Bash, or Other):

  • Guest limit: Strictly capped at a maximum of 12 participants.

  • Deposit: A 25% Non-Refundable Deposit is required to secure your booking date.

  • Final Balance: Due strictly 10 days prior to the event date. Cancellations under 10 days forfeit all monies paid due to custom pre-purchased project blanks and dedicated staffing.

  1. Cancellations by the Studio: If an academy class is cancelled due to instructor illness or venue closure, we will offer a makeup session, a credit voucher, or a pro-rata refund.

SECTION 6 – CLASSROOM SAFETY, MEDIUMS & PLUMBING PROTOCOLS

  1. Safe Classroom Mediums: Classroom instruction is strictly limited to non-toxic water-mix mineral composite powders, artist-grade polymer clay (oven-cured at 130°C), alcohol inks, texturing pastes, and fluid acrylics.

  2. Resin Safety Exclusion: To protect young lungs and prevent chemical sensitization, two-part epoxy resins, deep UV resin pours (>5mL), polyurethane foams, and open flame/butane torches are strictly prohibited from public classrooms. All epoxy resin work is conducted offsite in our ventilated private artisan studio using professional PPE.

  3. Plumbing & Drain Protection: Participants must follow the studio's mobile 3-stage closed-loop settling bucket system. Zero mineral casting powder, clay slurry, or plaster rinse-water may be poured down venue or council sink drains.

  4. Code of Conduct: We foster a kind, low-sensory environment. We reserve the right to remove any participant whose behavior repeatedly compromises the safety, sensory comfort, or well-being of the group, without refund.

SECTION 7 – ASSUMPTION OF RISK, FIRST AID & MEDICAL CONSENT

  1. Assumption of Risk: Tactile art and making involve craft knives, clay rollers, texturing tools, countertop convection heat, and powdered mineral mixes. By registering, you voluntarily assume all ordinary risks of minor personal injury or damage to clothing.

  2. Emergency First Aid: Studio facilitators hold active Tasmanian Working with Vulnerable People (WWVP) registrations and current Workplace First Aid / CPR certifications. You authorize staff to administer basic first aid (recorded in the official Incident Log) and arrange emergency ambulance transport at your expense if urgent hospital care is deemed necessary.

  3. Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). To the extent permitted by law, our liability for failure to comply with a consumer guarantee is limited to supplying the services again or refunding the cost of the services.

SECTION 8 – STUDENT PROPERTY & UNCLAIMED ARTWORK

  1. Physical pieces made during single workshops (such as terrazzo coasters or trinket dishes) may require set curing times.

  2. Any projects not taken home at the end of class must be collected from the venue within 14 days of completion. Due to limited storage at our community teaching hubs, items remaining unclaimed after 14 days will be recycled, repurposed, or discarded.

SECTION 9 – INTELLECTUAL PROPERTY & MEDIA RELEASE

  1. Instructional Materials: All course syllabi, casting recipes, project workbooks, and digital publications (including the Bloom at Home companion guides) are the exclusive intellectual property of Breathe & Bloom Design and are protected by Australian copyright laws. You may not record, reproduce, redistribute, or teach these proprietary processes for commercial gain without our prior written consent.

  2. Photography & Social Content: We occasionally take documentary photos and video clips focusing on creative hands, tactile processes, and finished pieces for our website and social channels. If you do not wish for yourself or your child to be photographed, you may check the Opt-Out box on your enrolment waiver, and your preference will be strictly respected.

SECTION 10 – SHIPPING, DELIVERY & TRANSIT

  1. Physical goods are dispatched using compostable, recyclable, and waterproof unboxing packaging.

  2. Delivery timeframes provided at checkout are estimates only. While we dispatch orders promptly via reputable Australian carriers, we are not liable for transit delays caused by carrier disruptions, weather events, or transit logistics.

  3. Risk of loss passes to you upon delivery of the items to the carrier. Please ensure shipping addresses entered at checkout are secure and complete.

SECTION 11 – THIRD-PARTY TOOLS & PLATFORMS

  1. Platform Operations: Our online sales are hosted on Shopify, card processing is handled via Stripe and Square POS, and back-office accounting is powered by Xero.

  2. Relationship with Shopify: Sales and bookings are entered into directly between you and Breathe & Bloom Design. Shopify acts solely as an e-commerce platform provider and bears no liability for transactions, workshops, or physical products provided by Breathe & Bloom Design.

SECTION 12 – INDEMNITY You agree to defend, indemnify, and hold harmless Breathe & Bloom Design, its founder, casual educators, and contractors from and against any claims, liabilities, damages, losses, or legal expenses arising from your violation of these Terms, your failure to disclose relevant medical or behavioral conditions, or your intentional damage to venue property or studio equipment.

SECTION 13 – SEVERABILITY & ENTIRE AGREEMENT If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and Breathe & Bloom Design regarding the Services.

SECTION 14 – GOVERNING LAW & JURISDICTION These Terms are governed by and construed in accordance with the laws of the State of Tasmania, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Tasmania and the Federal Court of Australia sitting in Hobart.
